Before the Court is a motion to dismiss pursuant to Fed. R. Civ. P. 12(b)(1) and 12(b)(6) filed by defendant, the Board of Governors of Colorado State University (“the Board”). The case arises under the qui tam provisions of the False Claims Act (“FCA”), 31 U.S.C. § 3730, and therefore the Court has jurisdiction pursuant to 28 U.S.C. § 1331.
