This suit was commenced before a justice of the peace, on a contract of affreightment made by the defendant as a common carrier. Judgment was rendered by the justice in favor of the plaintiffs, and the defendant appealed to the Circuit Court, and in that court filed a motion to dismiss the suit upon the ground that the justice had no jurisdiction over the defendant on contracts of affreightment.
