*657In an action to recover damages for breach of a lease, the plaintiff appeals from so much of an order of the Supreme Court, Queens County (McDonald, J.), entered November 21, 2008, as granted those branches of the defendant’s motion which were, in effect, pursuant to CPLR 3211 (a) to dismiss the first through sixth and eighth causes of action of the amended complaint.
Ordered that the order is modified, on the law, by deleting the provision thereof granting those branches of the motion which were to dismiss the first through sixth causes of action of the amended complaint, and substituting…
