Defendant is a corporation engaged in general ■ construction and contracting work in the State of Missouri and elsewhere.. At the time of the injury complained of, defendant was engaged in the construction of a tunnel under the Missouri River, beginning in Olay county, Missouri, about a mile northwest ■ of North Kansas City, the said tunnel being part of the. new waterworks system for the city of Kansas City, Missouri.
