Long, P. J.,

Defendant was found guilty of reckless driving on April 2,1937, and sentenced by the justice of the peace to pay a fine and costs, and in default thereof was committed to the county jail. On the same day and prior to the time the transcript was filed (April 14, 1937), defendant, having various remedies, sought to be released from imprisonment and chose the most convenient and expeditious method, to wit, an appeal.
