This is action of trespass on the case for negligence brought by Manuel Fonceca to recover damages for the death of his wife, Rose Fonceca, as a consequence of being struck down by defendant's motor truck while she was crossing Exchange street near its intersection with North Main street in the City of Pawtucket. The case was tried before a justice of the Superior Court sitting with a jury and, at the conclusion of the testimony, on motion of the defendant, the court directed the jury to return a verdict for the defendant on the ground that plaintiff's deceased wife was guilty of contributory…
