Appellee-defendant Chicago Southshore and South Bend Railroad (Southshore) has petitioned for rehearing asking us to set aside the portion of our decision in Northern Indiana Commuter Transportation District v. Chicago Southshore and South Bend Railroad, 661 N.E.2d 842 (Ind.Ct.App.1996), in which we overturned a portion of an arbitration award in favor of Southshore.
