District Court, E.D. Pennsylvania
1Opinion of the Court
OPINION
JOHN MORGAN DAVIS, District Judge.
We have before us the defendant’s motion to dismiss the complaint on the ground that this court has no jurisdiction over the subject matter due to lack of diversity of citizenship.
Mark A. Hanichak, a minor and a citizen of Pennsylvania, suffered injuries on May 24, 1964 allegedly as a result of the negligence of the defendant railroad, also a citizen of Pennsylvania.
