This is a petition for a writ of certiorari to review the decision of the board of review of the city of Newport denying the petitioners’ application for a special exception to use certain land owned by them in a business district.as a gasoline service station. Pursuant to the writ the pertinent records have been certified to this court.

Under §78-3(6) of the zoning ordinance a gasoline filling station is not permitted in a business district unless a special exception therefor has first been granted by the board. The requirements for a special exception in a business district are set forth in…
