Appeal from a judgment of the Supreme Court (O’Shea, J.), entered December 19, 2007 in Chemung County, which denied petitioner’s application for a writ of habeas corpus, in a proceeding pursuant to CPLR article 70, without a hearing.

Following his conviction of criminal possession of a controlled substance in the fourth degree, petitioner was sentenced as a second felony drug offender to 2V2 years in prison, to be followed by two years of postrelease supervision. The sentence and commitment order directed that petitioner serve his time under parole supervision at Willard Drug Treatment Center…
