WOOD, District Judge.
This suit was originally instituted in the Northern District of Illinois on June 13, 1960. Neither of the defendants filed an answer in Illinois; nor has an answer been filed to date. However, the defendant Triangle Publications, Inc. (hereinafter referred to as “Triangle”) filed in Illinois both a motion to dismiss for failure to state a claim and a motion to transfer the suit to the Eastern District of Pennsylvania.
