The School District of the Township of Blythe, Schuylkill County, plaintiff, brought this suit in assumpsit, under the provisions of the Act of June 20, 1939, P. L. 508, section 2(b), against Mary-D Coal Mining Company, Inc., defendant, to recover delinquent and unpaid school taxes for the years 1939 to 1942, inclusive, together with penalties and interest. Defendant filed an affidavit of defense, denying liability on the ground that the coal lands upon which the taxes were assessed and levied by plaintiff were sold by virtue of a treasurer’s sale to the County…
