In March 1988, Leroy Dykes and other residential property owners (residents) in Mountain Brook sued the City of Mountain Brook (the City) and the Mountain Brook Board of Education (the Board), seeking, among other things, damages and an injunction. The subject of the complaint was the development of an athletic complex by the City on property which was owned by the Board and which was located adjacent to Mountain Brook High School.
