Probably very few, if any, students who have graduated from American law schools during the past fifty years have not been made aware of the landmark case of Palsgraf v. Long Island Railroad Company, 248 N.Y. 339, 162 N.E. 99 (1928). In that case, the then Chief Judge of the Court of Appeals in New York, Benjamin Cardozo, wrote: “One who seeks redress at law does not make out a cause of action by showing without more that there has been damage to his person.” 162 N.E. at 101.
