Defendant, William E. Vincent, was charged in the district court of Oklahoma county with the crime of unlawful possession of intoxicating liquor and, as a second offender, was tried, convicted and sentenced to pay a fine of fl,000, and serve six months in the penitentiary, and has appealed.

This case involves the same defendant as the case of William R. Vincent v. State, 75 Okla. Cr. 116, 129 P. 2d 196. These cases were the outgrowth of searches and seizures of intoxicating liquor at defendant’s place of business, “The Alamo Courts”, on the 5th day of October, 1949. By reason of the facts…
