Crumley brings this action against Time Warner Cable, Inc. (TWC), alleging that TWC “deceptively and unlawfully overcharged customers for upgrades to its cable television service, for which it previously had been reimbursed,” and seeking both money damages and declaratory relief. The case is before the Court on a Report and Recommendation issued by the Honorable Jeanne J. Graham, United States Magistrate Judge, on March 7, 2008.
