The plaintiff and the infant defendant appeal from a final judgment sustaining a demurrer to the complaint. . The complaint *233shows that Charles G. Stachelberg died in the city of Hew York -on the 23d day of April, 1900, leaving a last will and testament which was duly admitted to probate. Iiis wife, the defendant Linda S. Stachelberg survived him. The infant defendant Charles G. Stachelberg, the son of the testator, Avas born after the death of the father and in December, 1900, and is the only issue of the marriage.
