On the 7th day of March, 1868, the assignor of the complainants, to secure the payment of $1,500 and interest, took a> mortgage from John Meighan on certain real estate in the Town-of Union, Hudson county.
*220On the 14th day of May, 1868, John Meighan and wife conveyed the same premises to John Meehan, subject to the said mortgage, the deed reciting that the principal of the said mortgage was included in and formed part of the consideration money thereof.
