On December 23,1926, appellant instituted an action against R. B. McCracken in the Conway Circuit Court for $984.16 on open account, and caused a writ oif attachment to be levied upon his stock of merchandise and fixtures in Morrilton, Arkansas. Thereafter, on January 3,1927, other of McCracken’s creditors filed an involuntary petition in bankruptcy against him, and appellee was appointed receiver of said estate.
