specially concurring. I am of the opinion that Saye & Davis Transfer Company is a common carrier. They were so incorporated, and they are transporting goods for hire on the public highways of the State. The fact that they are restricting themselves at any given time to a limited number of persons, with whom they make individual contracts, does not make them private carriers. The character of transportation is the same as if they were common carriers.
