This cause was submitted on briefs at the October teim, 1944. It was apparent that an important principle was involved and that the record was deficient in essential respects. Rather than dismiss the appeal because of the inadequacy of the record, the court requested counsel to amplify it and to argue the questions involved. This was done at the May term, 1945.
