FENNER, Judge.

Appellant, Monte Roden, appeals the judgment of the trial court sustaining respondent’s motion for summary judgment in appellant’s cause of action for alleged legal malpractice.

Appellant alleged in his malpractice action that respondent’s representation in a cause of action that appellant filed in the United States District Court under 42 U.S.C. § 1983, (hereinafter referred to as appellant’s federal action), constituted malpractice.
