This is an action on the case brought by Mary Gruber, plaintiff in error, against the LaSalle County Carbon Coal Company, defendant in error. The suit was begun January 10, 1908. The declaration was filed May 27,1908, and alleges that the defendant company was operating a certain coal mine in said county on the thirteenth day of January, 1906, and that John Gruber, the plaintiff’s husband, was working in the mine as a miner before and on that day and that at his working place he was exposed to a dangerous condition in the roof of the place that had long been there; that he had to work exposed…
