This bill was filed to enjoin respondents from removing or interfering with any of complainant’s poles and wires in the streets of the city of Pomona, and asserts a right of occupancy for said poles and wires in said streets, upon the following grounds, to wit: First, the act of Congress entitled “An act to aid in the construction of telegraph lines and to secure to the government the'use of the same for postal, military, and other purposes,” approved July 24, 1866 (14 Stat. 221, c. 230); second, section 536 of the Civil Code of California; third, an alleged contract…
