Affirming.
Henry Helton and Pink Fultz were jointly indioted in tlie Harlan circuit court charged with the murder of Harmon Hall. A change of venue was granted to the Clay circuit court on motion of the Commonwealth. In a 'separate trial in that court Helton was convicted of manslaughter and his punishment fixed at 21 years in the penitentiary.
