In an action to recover damages for personal injuries, the defendants appeal, as limited by their brief, from so much of an order of the Supreme Court, Kings County (Balter, J.), dated February 13, 2008, as denied that branch of their motion which was, in effect, to refer issues concerning the plaintiffs employment status to the Workers’ Compensation Board for determination.
Ordered that the order is affirmed insofar as appealed from, with costs.
