Appeal from an order of the Surrogate’s Court of Madison County (McDermott, S.), entered September 2, 2015, which, in a proceeding pursuant to SCPA article 14, among other things, denied respondent Jennifer M. Basic’s motion for summary judgment dismissing the petition.

Denise H. Bordell (hereinafter the wife) had been married to Maurice J. Bordell (hereinafter decedent) for over 40 years at the time of his death on January 11, 2014.
