In this proceeding pursuant to section 298 of the Executive Law to set aside and annul an order of the State Human Rights Appeal Board, entered April 19, 1977, which affirmed an order of the State Division of Human Rights entered November 18, 1975 that dismissed petitioner’s complaint for lack of probable cause, respondent’s cross motion to dismiss the petition as untimely is unanimously granted and the petition is dismissed, without costs and without disbursements.
