By articles of agreement, dated December 31,1904, duly executed, acknowledged and delivered, the defendant, John W. Thompson, purchased from the plaintiff, Leonard Horner, Jr., about thirty acres of land located in Logan township, Blair county, Pennsylvania, for the price of $6.00 per acre, paying $8.00 in hand at the date of the agreement and the balance of the purchase money was to be paid annually as stipulated in the contract.
