In October, 1934, Eli Elkan filed his petition against Bibb County, the board of commissioners of said county, and the sheriff, seeking to set aside a tax sale at which Bibb County was the purchaser, and for other relief. By amendment the Penn Mutual Life Insurance Company and L. Snyder were made parties defendant. The petition as amended set forth substantially the following facts and contentions.
