COXE, District Judge.

These suits- grow out of a collision in the North River on November 13, 1929, between the steamship Neches, of the Clyde-Mallory Lines, and the tug No. 31 and the car float No. D-l, both belonging to the New York Central Railroad Company.

The collision occurred at about 5:42% p. m. ■ on November 13, 1929, about 1,000 feet off Piers 19 or 20, North River, The weather at the time was misty, the visibility fair—variously estimated at from one-half mile to a mile or two, and the tide was the last of the flood.
