delivered the opinion of the court:

Defendant the City of Lincoln appeals from an order of the circuit court of Logan County finding that defendant had no easement rights in, to or across the property of plaintiffs Kenneth and Nelda Seefeldt.

Plaintiffs filed a complaint for injunction against defendants the City of Lincoln and Merrill’s Contractors, Inc. Merrill’s did not file any responsive pleadings and does not appeal the court’s order, therefore, the term “defendant” will be used to refer only to the City of Lincoln.
