Plaintiff Arthur B. Mendelson filed this suit to recover damages against defendant Ben A. Borenstein & Company based on defendant’s alleged breach of the parties’ construction contract. The circuit court of Cook County entered summary judgment against plaintiff and simultaneously denied plaintiff leave of court to file a third-amended complaint.
