Appellee sued appellant in the justice court of Nacogdoches county for the value of a horse killed through its' negligence, and recovered judgment for the sum of $100 as the value, of the horse, and $20 attorney’s fees. Appellant appealed to the. county court, where, upon a trial de novo, appellee recovered judgment for $50 as the value of the horse. Without the knowledge or consent of the trial court, and before any order was- made adjudicating the costs, ap-pellee prepared and had the clerk of the county court enter upon his minutes a judgment in her favo.r against appellant for the sum of…
