DODGE, District Judge.

Whether the writ is to be issued or not is to be determined in this case from the record of proceedings by the immigration authorities under warrants issued by the Secretary of Commerce and Labor, under sections 20 and 21 of the Immigration Act of 1907 (Act Feb. 20, 1907, c. 1134, 34 Stat. 904, 905 [U. S. Comp. St. Supp. 1909, p. 459]), for the arrest and deportation of Haiganoosh Avakian. She is an alien, born in Turkey, alleged by the petitioner to be his niece.
