Appeal from an order of the Court of Claims (Benza, J.), entered August 10, 1998, which granted the State’s motion for summary judgment dismissing the claim.
On December 14, 1994, Ralph Tortorici entered a lecture hall on the campus of the State University of New York at Albany (hereinafter SUNYA) where he was enrolled as a student. Brandishing a gun, he ordered the professor to call certain elected public officials and the media.
