This case was presented to this court by the following statement as a case-made. It is brief and concise, and very fairly presents the questions for determination :

“This was an action in the district court of Leavenworth county in the nature of ejectment, commenced January 6, 1885, to recover 136q^- acres of land, the rents and profits thereof and damages thereto, from the 1st day of March, 1881. The case was tried on the 29th day of April, 1886, by a jury, and a verdict rendered in favor of the plaintiff for *393the possession of the land and for $384.50 damages. Upon the…
