LYDON, Senior Judge.
This case, brought under the Contract Disputes Act of 1978 (41 U.S.C. § 601, et seq.), is before the court on motions for summary judgment. Plaintiff, Sucesión J. Serralles, Inc., seeks damages in the principal amount of $478,417.85 based on the alleged failure of defendant, the U.S. Army Corps of Engineers, to “aesthetically dress” plaintiffs land from which clay was excavated for use in building the Cerrillos Dam near Ponce, in south-central Puerto Rico.
