This decision addresses an issue of first impression under New York’s Sex Offender Registration Act (SORA): Does the “Position Statement” dated June 1, 2012 by the New York State Board of Examiners of Sex Offenders (the Board) regarding the scoring of child pornography cases under the New York sex offender risk assessment instrument (the RAI) change the manner in which such cases must be scored under the instrument?
