In this case writ of error has been taken to an order of the Circuit Court setting aside and vacating a default judgment and final judgment at law consequent thereon and recalling a writ of .execution issued pursuant thereto. The effect of the order appealed from is to set aside and vacate a final judgment entered during a regular term of the Circuit Court after a trial was had and the verdict of a jury was returned respecting the issues to be tried under the pleadings and the default.
