Messmore, District Judge.

This is an appeal from the district court for Douglas county, wherein that court dismissed the case and discharged the jury at the conclusion of appellant’s testimony.

The action is one for malicious attachment. Only the evidence necessary for a determination of the case will be set forth in this opinion. Appellant was a resident of Omaha for a number of years, was engaged in the cigar business there and had transacted business with the appellees Beselin for some years.
