This is an action to annul the testament of Willis Wood and the decree ordering its execution.

From an adverse judgment the plaintiffs appeal.

Of the numerous grounds set forth in the petition, three only will be noticed. They are:

1.That the will was not executed in compliance with the formalities required by law in making nuncupative wills under private signature.

2.That the will was made in violation of the law whichforbids two or more persons from making a testatment by the same act, for the benefit of a third person.
