Appeal by the plaintiff, Frank McLaughlin, from a judgment of the Supreme Court in favor of the defendants, entered in the office of the clerk of the county of New York on the 31st day of August, 1899, upon the dismissal of the complaint by direction of the court after a trial at the New York Trial Term before the court and a jury. This appeal was transferred from the first department to the second department.

Hatch, J.:

The action was brought to recover damages for personal injuries claimed to have been sustained by the plaintiff on account of negligence on the part of the defendants. The evidence disclosed that the defendants had constructed a scaffolding or platform over a cable which ran at right angles to the structure, and which was for the purpose of enabling the employees to pass over the running cable without contact therewith, and also for the purpose of making *519use of the same to pass material to be used in the construction of a scaffolding above the one which is the subject of…
