Hilda Buckley commenced this action against the University of Arkansas Board of Trustees alleging that her employment with the University of Arkansas for Medical Sciences was terminated in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e-2 and the Age Discrimination in Employment Act of 1967, 29 U.S.C. § 623(a). The University has moved to dismiss pursuant to Rule 12(b)(1) of the Federal Rules of Civil Procedure on two grounds.
