The parties will be designated as in the trial court. This is an action for the purpose of establishing a trust in certain lands described in the petition. Both parties to this action are duly enrolled citizens of the Cherokee Nation, and this action was brought by Robert L. Higgins as guardian for Vinita Higgins, a minor, against John W. Waters, also a minor, to charge the lands in controversy with a trust in her favor for the alleged reason that there was no evidence before the ■ Secretary of the Interior to sustain the findings of said Secretary in a certain contest…
