Reversing.

The appellee, Kentucky River Coal Corporation, has for a considerable time been the owner of a large acreage of coal bearing land in eastern Kentucky, the larger portion of which (and possibly all) lies in Perry and Knott counties, which adjoin. Appellee does not appear to be an operating company, but leases its property to others for mining purposes on a royalty basis, with a guaranteed minimum royalty.
