On the 15th day of October, A. D. 1891, the plaintiff in error was indicted in the Circuit Court for Madison county. The indictment, leaving out some of its-formalities, is as follows: The grand jurors for the-State of Florida, duly chosen, empanelled and sworn diligently to inquire and true presentment make in. and for the body of the county of Madison, and third judicial circuit of said State, upon their oaths present that Henry C.
