Plaintiff, C. L. Flake, Jr., a real estate developer, was involved in a large number of loan transactions with the defendant — Gwinnett Commercial Bank, during the years 1974,1975, and 1976. He was developing realty with different persons, partnerships, and corporations. As a result of the many purchases, sales and transfers of various properties, numerous promissory notes and guaranty contracts were executed with the defendant bank. Flake used as collateral for his loan and guaranty transactions, a $440,000 Certificate of Deposit issued by the defendant bank. The…
