In an action, inter alia, to recover on an account stated, the defendant appeals from (1) an order of the Supreme Court, Kings County (Schmidt, J.), dated June 26, 2007, which granted the plaintiffs motion for summary judgment on the third cause of action to recover on an account stated, and (2) a judgment of the same court dated September 23, 2008, which, upon the order, is in favor of the plaintiff and against it in the principal sum of $102,415.37.
Ordered that the appeal from the order dated June 26, 2007, is dismissed; and it is further,
Ordered that the judgment is reversed, on the law,…
