HICKENLOOPER, Circuit Judge.

This is an appeal from a judgment of the District Court refusing to adjudicate the defendant an involuntary bankrupt in proceedings there pending. 11 USCA § 48.

The appellee, the Ohio Farmers’ Co-operative Milk Association, is a corporation organized under the Ohio Co-operative Marketing Act, sections 10186-1 to 10186-30 of the General Code of Ohio.
